Terms of Use

1. Nature of the platform
CarDeal.co.nz ("the Platform") is a listing and display service for vehicle sales information. The Platform is an information intermediary only — not a buyer, seller, broker, or guarantor of any transaction. Buyers and sellers transact directly and at their own risk.
2. Seller responsibilities
Sellers must ensure listings are true and accurate (including condition, odometer, accident history and price). Under the Motor Vehicle Sales Act 2003, anyone selling more than 6 motor vehicles in 12 months must register as a Motor Vehicle Trader (MVT). Registered traders must comply with the Consumer Guarantees Act 1993 and Fair Trading Act 1986, including displaying a Consumer Information Notice (CIN).
3. Licence to your content
You retain ownership of the listing details, text and photos you upload ("Your Content"). To operate the Platform, you grant us a non-exclusive, royalty-free, worldwide, limited licence to use, reproduce, store, adapt and display Your Content for the purposes of showing your listing, generating bilingual versions (machine translation), compressing and hosting images, and presenting it in search results. This licence is limited to what is necessary to provide the Platform's services and ends within a reasonable time after you delete the listing or your account (except for copies required by law or held in backups). You warrant that you hold all rights needed to upload Your Content and grant this licence.
4. Importing content from other sites
The Platform offers an "import from URL" feature that fetches vehicle details and images from a link you provide, to pre-fill the listing form. You must ensure that: (a) you own the vehicle or are authorised to publish the content; and (b) the imported text and images do not infringe any third party's copyright or other rights. Imported content is a draft and is only published after you review and confirm it. You are solely responsible for, and indemnify the Platform against, any claim arising from importing or publishing infringing content. The Platform may remove content suspected of infringement.
5. Machine translation
Listing descriptions and in-app messages are translated automatically and provided for convenience only. Where a translation differs from the original, the original text prevails. The Platform accepts no liability for translation accuracy.
6. Messaging and prohibited conduct
When using in-app messaging and listing features you must not: post false, misleading, infringing or unlawful content; trade while posing as a private seller (curbstoning); send harassing, spam or fraudulent messages; harvest others' personal information for any purpose beyond contacting them on the Platform; or interfere with the Platform's operation. The Platform may review and remove content that breaches these terms.
7. Suspension and termination
If you breach these terms, or to protect the safety and trust of the Platform and its users, we may suspend or terminate your account and remove related listings, where reasonable and without prior notice if necessary. You may also stop using the Platform and request deletion of your account at any time.
8. Platform intellectual property
The Platform's name, logo, interface design, code and content created by the Platform belong to the Platform or its licensors and are protected by law. You may not copy, scrape, republish or use them commercially without permission. This clause does not affect your ownership of Your Content.
9. Limitation of liability
To the maximum extent permitted by law, the Platform is not liable for disputes between users, vehicle defects, or any loss arising from use of the Platform. Nothing in these terms limits your statutory rights under New Zealand consumer law.
10. Governing law and disputes
These terms are governed by the laws of New Zealand and subject to the exclusive jurisdiction of the New Zealand courts. Any dispute between a buyer and seller is to be resolved between them; the Platform is not a party to it. If any provision of these terms is held invalid or unenforceable, the remaining provisions continue in effect.
11. Changes
We may update these terms from time to time. Continued use after an update constitutes acceptance. Material changes will be flagged on the site.
